On 4 December, European Parliament and European Council negotiators reached a provisional deal on the new Ecodesign for Sustainable Product Regulation (ESPR).

Background

On 30 March 2022, the European Commission published its proposal for the Ecodesign for Sustainable Products Regulation (ESPR). The Council adopted its negotiating position on 15 May 2023; the Parliament on 12 July 2023. Negotiations have proceeded in the past 4-5 months. The co-legislators have now found a provisional deal.

Major provisions

The ESPR will replace the current Ecodesign Directive and extend its scope to all products.

It aims to regulate all lifecycle environmental impacts, not just energy performance. This might include setting carbon or environmental footprint requirements for some products.

It further aims to make products last longer, easier to repair and recycle, contain fewer substances of concern, and include more recycled content.

The ESPR also bans the destruction of certain types of unsold consumer products, including textiles and footwear. The Commission will be empowered to introduce new bans for the destruction of other unsold products by delegated acts.

The ESPR would require disclosing some product information to consumers and recyclers through a Digital Product Passport (DPP). The DPP would be a standardised but decentralized way to give instant access to product information through a data carrier affixed on the product, like a QR code or bar code. What information will be required in the DPP is yet to be defined in product-specific delegated acts. It might vary from product to product.

The ESPR is a framework regulation. Detailed requirements for specific products will still have to be implemented through delegated acts.

First product priorities

The first products to be targeted for delegated acts will be defined in the first ESPR working plan. The Commission held a public consultation in the first half of 2023 to gather input on what would be good first priorities. The report should become available in Q1 2024, probably after publication of the ESPR. So far, the focus seems to be on textiles, garments, footwear, furniture, mattresses, iron, steel, aluminium, tyres, paints, lubricants, chemicals, ICT products and other consumer electronics.

Energy-related products already regulated under the current Ecodesign Directive will continue to be reviewed, but according to a separate working plan.

Next steps

With the big political questions resolved, there is still some work to be done at technical level to settle minor provisions in the legal text. After that, the provisional legal text should become available. This might still take a few weeks.

If endorsed by Council and Parliament, the deal will then be translated into all EU languages, formally adopted, and published in the Official Journal of the EU.

Brussels, 28 November 2023. The Eurovent Product Group ‘Air Handling Units’ re-elected Martin Lenz (TROX) as the group’s Chairperson and Andy Bijmans (Systemair) as its Vice-Chairperson. The election took place during the group’s last meeting in Hinwil.

Participants of the Eurovent Product Group ‘Air Handling Units’ (PG-AHU) re-elected Martin Lenz, Head of International Business Development / Head of Research and Pre-Development at TROX GmbH (Germany) as the group’s Chairperson during the group’s recent meeting in Hinwil. Martin will continue to be supported by Andy Bijmans, Manager R&D at Systemair (Netherlands) who was also re-elected as Vice-Chairperson of the group. Martin and Andy were both initially elected to chair the group in 2017, due to their broad experience and knowledge in the air handling sector and look forward to continuing the task for the next two years.

Martin Lenz, Chairperson of PG-AHU, indicated: “In today’s world, air handling units are an important part of ensuring the quality of life in buildings. At the same time, climate change requires highly efficient and sustainable HVAC systems and components. For PG-AHU, this means a clear focus on technological progress in terms of quality for a long lifetime, energy efficiency and material efficiency. I am convinced that with the strong participation of AHU manufacturers in the PG-AHU, we will successfully overcome these challenging issues.”

Andy Bijmans, Vice-Chairperson of PG-AHU, added: “I am looking forward that we, as a Product Group with very active members, can together serve the market expectations from our end-users, concerning the three main items of the moment, Indoor Air Quality, energy efficiency and sustainability in all aspects of air handling units, such as reliable technique, construction, (European) regulations and norms.”

The Eurovent Product Group ‘Air Handling Units’ covers air handling units for non-residential applications. It deals with air handling units and their components (e.g. air filters, energy recovery components, fans), often in cooperation with the specialist Eurovent Product Groups that cover specific components. The group’s key tasks involve advocating European and national legislative initiatives on this subject, accompanying EN, and ISO and standards, developing industry codes of good practice, and general promotion of the industry.

Cette recommandation, élaborée dans le cadre d’un effort conjoint des participants de PG-RVS, vise à renforcer l’application des exigences en matière d’écoconception et d’étiquetage énergétique pour les unités de ventilation résidentielle double-flux mises et mises en service sur le marché de l’UE. Il s’adresse principalement aux fournisseurs et aux autorités de surveillance du marché.

Les six premiers chapitres fournissent le contexte législatif général et une vue d’ensemble des exigences spécifiques auxquelles les fournisseurs sont soumis. Le chapitre 7, qui s’adresse en particulier aux autorités de surveillance du marché, présente des conseils pratiques pour faciliter un contrôle efficace de la conformité. Le chapitre 8 présente les avantages de la certification volontaire par des tiers pour la surveillance de la conformité des produits.

Eurovent has published a French version of its Recommendation 20/1 on residential ventilation systems. The Recommendation focuses on Ecodesign and Energy Labelling compliance of bidirectional residential ventilation units.

This Recommendation was prepared in a joint effort by participants of the Eurovent Product Group ‘Residential Ventilation Systems’ (PG-RVS). It aims to enhance the enforcement of Ecodesign and Energy Labelling requirements for bidirectional residential ventilation units placed and put into service on the EU market. It is primarily addressed to suppliers and market surveillance authorities.

The first six chapters provide the general legislative background and an overview of the specific requirements, which suppliers are subject to. Chapter 7, particularly aimed at market surveillance authorities, presents practical tips to facilitate effective compliance monitoring. Chapter 8 outlines the benefits of voluntary third-party certification for monitoring product compliance. The document can be downloaded free of charge on the Eurovent website.

Brussels, Boras, 14 November 2023. The Research Institutes of Sweden (RISE) has formally joined Eurovent as an Associate Member. Its membership was approved during the Board of Directors meeting that took place on 19 September 2023.

RISE is a Swedish state-owned research institute that offers expertise and around 100 test and demonstration environments for future-proof technologies, products and services. RISE’s activities include testing, calibrations and chemical analyses, research and development, control, assessments and normalisation and it functions as national metrology institute. RISE is on a national, European and international level known for performing tests for different certification and quality label schemes and it also certifies products.

Ms Monica Axell, Head of Research and Business Development at RISE Research Institutes of Sweden, stated: “We look forward to joining Eurovent and to be given an opportunity to work for greener and smarter buildings with the industry. This webinar is tailor-made for end users, building owners, facility managers, designers, architects, commissioning engineers, contractors, installers, planners, specifiers and consultants from around the globe. The core aim is to dive deep into a comprehensive overview of features that determine highly efficient operation and correct service of Air Handling Units.

The webinar will address a wide range of aspects, such as properties of the casing and individual components, energy efficiency and controls requirements, maintainability, and the content of technical documentation.
